What Is the Medicare GLOBE Rule?
The Pharmaceutical Research and Manufacturers of America (PhRMA) has filed a federal lawsuit challenging the Trump administration’s newly finalized GLOBE rule. The regulation is designed to establish hospital drug prices for Medicare patients by integrating a "most favored nation" pricing system based on costs in a group of comparable countries.
The rule specifically impacts the Medicare Part B program, which provides health coverage to about 70 million Americans aged 65 and older or with disabilities.
Details of the PhRMA Lawsuit
The lobby group filed its lawsuit in the US District Court for the District of Columbia. Defendants named in the suit include:
- Health Secretary Robert F. Kennedy Jr.
- The US Department of Health and Human Services (HHS)
- The Centers for Medicare & Medicaid Services (CMS)
- CMS Administrator Dr. Mehmet Oz and innovation center director Abe Sutton
PhRMA General Counsel Jim Stansel argued that CMS has stretched its authority to test new pricing models into rewriting Medicare’s pricing structure without congressional action. According to the lawsuit, CMS is implementing a structure that Congress has declined to adopt multiple times over the years.
Limited Reach and Projected Savings
While the lawsuit challenges the long-term implications of the policy, the GLOBE rule itself is expected to have a limited initial reach:
- Exemptions: CMS plans to waive the rule for manufacturers that have signed separate voluntary drug pricing deals with the White House, such as Pfizer, Eli Lilly, and Novo Nordisk. This could leave the rule applying to as few as four drugmakers.
- Savings: In the finalized version of the rule, HHS estimates the program will reduce Medicare Part B spending by about $440 million over a 7-year period, down significantly from the roughly $11.9 billion projected in the initial proposed rule.
Legal experts note that the lawsuit serves as a broader effort to prevent future administrations from using similar mechanisms to impose mandatory drug price controls.
